Terms of Service

Use of the Application

a. Eligibility: To use the Application, you must have at least two Shopify stores and intend to reach a targeted audience through organic search. By using the Application, you represent and warrant that you meet these eligibility requirements and have the right, authority, and capacity to enter into this Agreement and to abide by its terms.

b.Hreflang Tags: The Application allows you to manage hreflang tags in all your Shopify stores from one place. Hreflang tags are tags that inform search engines about the language or region of your website pages, helping users find the most relevant content based on their language or location.

c. SEO Improvement: By using hreflang tags, you can improve your Shopify stores' search engine optimization (SEO) positions. This helps avoid penalties for duplicated content and ensures that your localized store versions are recognized as separate entities by search engines.

d. Language Specificity: The Application also supports multilingual Shopify websites and allows for language specificity, including the use of handles (slugs) in local languages. This enables your customers to find products, collections, and other content in their preferred language, improving their overall experience.

Intellectual Property

a. Ownership: The Application, including its content, features, and functionality, is owned by Genovawebart, a company registered and incorporated under the laws of Poland, and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

b. Limited License: Subject to your compliance with this Agreement, Genovawebart grants you a limited, non-exclusive, non-transferable, and revocable license to use the Application solely for its intended purpose.

c. Restrictions: You may not modify, reproduce, distribute, create derivative works of, publicly display or perform, or otherwise exploit any part of the Application except as expressly authorized by Genovawebart. You may not reverse engineer, decompile, or disassemble the Application or attempt to derive the source code from it.

Privacy

a. Data Collection: By using the Application, you acknowledge and agree that Genovawebart may collect and process certain personal information as described in the Privacy Policy, which is incorporated by reference into this Agreement.

b. Third-Party Services: The Application may integrate with third-party services or websites. Your use of such services or websites is subject to their respective terms of service and privacy policies. Genovawebart is not responsible for the actions or policies of these third parties.

Disclaimer of Warranties

a.The Application is provided on an "as is" and "as available" basis. Genovawebart makes no warranties or representations of any kind, whether express, implied, or statutory, regarding the Application or its content, including any warranties of merchantability, fitness for a particular purpose, or non-infringement.

b.Genovawebart does not warrant that the Application will be uninterrupted, error-free, or secure, or that any defects or errors will be corrected. You assume all risks associated with your use of the Application.

Limitation of Liability

a. In no event shall Genovawebart be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your use of or inability to use the Application.

b. Genovawebart's total liability to you for any claims arising out of or relating to this Agreement or the Application shall not exceed the total amount paid by you, if any, for the use of the Application.

Indemnification

You agree to indemnify, defend, and hold harmless Genovawebart and its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or related to your use of the Application, your violation of this Agreement, or your violation of any rights of another.

Termination

a. Genovawebart may terminate this Agreement and your access to the Application at any time without prior notice for any reason, including if you breach any provision of this Agreement.

b. Upon termination, all rights and licenses granted to you under this Agreement will immediately cease, and you must stop using the Application.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Poland. Any dispute arising out of or relating to this Agreement or the Application shall be exclusively resolved by the courts of Poland.

Modifications to the Agreement

Genovawebart reserves the right, at its sole discretion, to modify or replace this Agreement at any time. The most current version of the Agreement will be posted on the Application. By continuing to use the Application after any revisions to this Agreement, you agree to be bound by the modified terms.

Entire Agreement

This Agreement, including the Privacy Policy and any other referenced policies or guidelines, constitutes the entire agreement between you and Genovawebart regarding the Application and supersedes all prior or contemporaneous understandings and agreements, whether written or oral, regarding the subject matter herein.
